Select the determination/rationale by clicking the radio button next to the desired option. Each of these options will generate a different correspondence that will sent to the employer (pending review of this workflow – shown in next task). The different rationale options breakdown as follows: • Affirm – Reverse Liability: DEW agrees with the protest and reverses the original decision. • Reverse – Correct Liability: DEW stands by their original ruling and the appeal is ‘denied’. • Remand – Further action needed: This happens later in the process at the higher levels of a protest, when it is determined to send this protest back down to a lower level. This would happen after a protest has raised past first level of protest. • Modify – Further action needed: It is decided that the original decision needs to be re-examined and more work needs to be done. Not a complete approval or denial of the protest. • Dismiss – No additional action: The protest is dismissed due to any number of reasons including lack of response (or in the event a hearing date was sent and the parties did not appear), the protest is withdrawn or some other reason. • Untimely – No additional action: The protest was filed in an untimely manner and the explanation for untimeliness was not valid. Note: For each document that an employer can protest, the Determinations/Rationale will be different to accommodate this for example, the protest displayed above is in regards to liability, and thus the rationale is related to liability. In the scenario the protest is in regards to annual rate, it would display rationale that relates to annual rates. Also, each type of protest will have different correspondence that is generated as a result of this process and the determination. |
